That’s a Real Job Contest: OFFICIAL RULES AND REGULATIONS (these “Official Rules and Regulations”)

IMPORTANT: PLEASE READ CAREFULLY AS THESE OFFICIAL RULES AND REGULATIONS FORM A CONTRACT BETWEEN YOU AND LET’S TALK SCIENCE/PARLONS SCIENCES.

By submitting an entry for the “That’s a Real Job” Contest (the “Contest”) you agree to be bound by the terms and conditions set out in these Official Rules and Regulations as if you had entered into and signed a contract with Let’s Talk Science/Parlons sciences (“us”, “we”, “our”, “Contest Sponsor”). PLEASE READ THESE OFFICIAL RULES AND REGULATIONS CAREFULLY AS THEY AFFECT YOUR RIGHTS AND OBLIGATIONS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT ENTER THE CONTEST.

1. ELIGIBILITY, NO PURCHASE NECESSARY. 

To be eligible to enter this contest, you must meet the eligibility requirements:

a.) You must be a resident of Canada (as determined by the rules that would apply to you, your parent, or your guardian under the Income Tax Act) between the ages of 10 and 17 years old and in grade 5-12 as of April 14, 2020.

b.) Your entry must be in either English or French. 

c.) Your parent or guardian must agree to the terms and conditions in these Official Rules and Regulations on your behalf. In the event that you are of the age of majority in your province or would be deemed to be of the age of majority for the purposes of contract law, you must agree to these Official Rules and Regulations.

d.) Employees of Let’s Talk Science/ Parlons sciences, and their respective partners, affiliates, subsidiaries, advertising and promotional agencies and the immediate family members and persons they reside with may participate if you meet the other eligibility requirements. 

e.) The Contest and these Official Rules and Regulations are VOID WHERE PROHIBITED BY LAW.

f.) You must follow the directions in section 2 to enter the Contest and otherwise comply with these Official Rules and Regulations and any other directions provided by the Contest Sponsor.

g.) This Contest is open to all Canadian residents, subject to the eligibility criteria set out in this section 1.

h.) No purchase is necessary to be eligible under this Contest. To be eligible for one of the early entrant prizes (as described below) you must correctly answer the skill testing question.

2. HOW TO ENTER.

To enter the Contest, you must submit your entry according to these directions between April 14, 2020 and May 15, 2020 and agree to be bound by these Official Rules and Regulations.

You must develop a concept for the next “That’s a Real Job” by answering the following questions in the form of a comic storyboard, image, video or written story (collectively, your “Submission”):

  1. What would you call this real job?
  2. What will that job do?
  3. Why will that job be important in the future? 

Complete the online entry form at letstalkscience.ca/contests – Google Form (the “Contest entry form”) and fill out all the mandatory fields. Upload your entry. 

Please read section 6 carefully as it outlines important rights that you are granting to us. Among those rights, by entering the contest, you consent to the release of your name and photograph. 

By entering the Contest, you agree, represent, and warrant to us that you have complied with these Official Rules and Regulations. To be eligible to win, you must meet all the eligibility requirements set out in section 1 or your participation in the Contest will be denied. All entries become the property of the Contest Sponsor and will not be returned to you. 

3. CONTEST PERIOD. The Contest opens on April 14, 2020. All entries must be received by 11:59 p.m. (Eastern standard time) on May 15, 2020. 

4.WINNER SELECTION. One (1) grand-prize winner and six (6) runners-up will be chosen from the entries meeting the eligibility criteria by a panel of independent judges whose decision is final. The six (6) runners-up will be chosen by selecting the top two (2) entrants in grade category 5-6, the top two (2) entrants in grade category 7-9, and the top two (2) entrants in grade category 10-12, for a total of six (6) runners-up. The grand prize winner shall be selected from among the six (6) runners-up. The first two hundred (200) entries (the “early entrants”) that meet the eligibility criteria will receive the early entrant prize.  (each of the grand prize winner, the six (6) runners up, and the two hundred (200) early entrants being a “winner”, and collectively being the “winners”). The panel of independent judges shall judge each Submission on originality, creativity, skill, and consistency with the themes of the “That’s a Real Job” series, in no event shall chance or random draw be used to determine a winner.

5. PRIZES. 

a.) The winners will be selected as set out in section 4.

b.) Each of the six (6) runners-up will receive one (1) $250 cash bursary.

c.) The one (1) grand prize winner will have their concept adapted into the next “That’s a Real Job” video and used in a national marketing campaign. 

d.) The early entrants will receive a $10 e-gift card to Apple iTunes, or Google play.

e.) The grand prize winner and six (6) runners up will be notified on or around May 25, 2020. The early entrants will be notified on or around May 1, 2020.

f.) The parent or guardian of the winners will be notified at the contact information set out in the Contest entry form, and all prizes will be presented to the parent or guardian of the prize winner at the contact information indicated on the Contest entry form. The Contest Sponsor is not responsible for errors in the Contest entry form, so please ensure that the information that you have entered is correct.

h.) All prizes must be accepted as awarded and no cash equivalent is available. NO SUBSTITUTION OF PRIZES IS PERMITTED EXCEPT BY CONTEST SPONSOR IN ITS SOLE AND ABSOLUTE DISCRETION. CONTEST SPONSOR MAY SUBSTITUTE ANY PRIZE WITH ANOTHER PRIZE OF EQUAL OR GREATER VALUE. PRIZES ARE NON-TRANSFERABLE AND ARE NOT REDEEMABLE FOR CASH OR CREDIT. 

6. RIGHTS OF CONTEST SPONSOR TO SUBMISSIONS

a) Ownership of your submission: you will retain all rights, title, and interest in and to your Submission, subject to the grant of licence and other terms provided for herein. 

b) Grant of Licence: By submitting your Submission, you agree to grant Contest Sponsor and its affiliates, successors, assigns, and direct and indirect licensees, a non-exclusive perpetual, irrevocable, freely transferable and sub-licensable, fully paid-up and royalty free right and licence to use your Submission, including all copyright and other intellectual property rights therein and all renewals, and all extensions thereof, in all formats and media, whether now known and existing or hereafter discovered or developed, throughout the universe, for all or any purposes whatsoever. For purposes of clarity and without limiting the foregoing, you agree that the foregoing grant includes the rights to (i) modify, edit, combine with other materials, translate, include in collective works and create derivative works (“Adapt”, “Adaptation”, “Adapted”); (ii) to perform or display, whether publicly or otherwise; and (iii) to reproduce and transmit your Submission, in whole or in part, and as provided by you unmodified or as Adapted. You hereby waive all moral rights to your Submission.

c) Ownership of Adaptations: Contest Sponsor owns and retains all rights, title, and interest in and to all Adaptations of your Submission made by, or made by any third party for the benefit of, Contest Sponsor, subject only to your rights in your underlying Submission.

d) Use of Your Name, Likeness and Information: You hereby grant to Contest Sponsor, its affiliates, and each of their direct or indirect successors, licensees and assigns, the right to use your name, likeness, and information provided as a part of the contest in connection with your Submission.

e) The Internet is not Secure and You Accept This Risk: You acknowledge and accept the risk inherent in the fact that the Internet is not a secure medium. Any material posted on the Internet is accessible to anyone with Internet access, and while we have made every effort to secure our web presence, we make no warranty or guarantee, whether express or implied, of privacy or controlled access to our web site or affiliate platforms. 

7. GENERAL TERMS AND CONDITIONS 

a) Contest subject to all federal, provincial and local laws, and regulations. This contest is void where prohibited. Applicable taxes, if any, are the responsibility of the winners. 

b) Entry constitutes agreement with all of the foregoing rules and terms, including, without limitation, permission to use the winner’s name, likeness, contest entry and information contained therein, statements, quotes, testimonials, photographs, and name of hometown for promotional purposes, including but not limited to posting of such information and reproduction and display on the Contest Sponsor’s websites, except where prohibited by law. Failure to comply with the contest rules may result in the entrant’s disqualification. 

c) The Contest Sponsor is not responsible for: (1) lost, stolen, illegible, torn, damaged, late, incomplete, or misdirected entries; (2) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures or difficulties; and (3) any condition caused by events beyond the control of the Contest Sponsors which may cause the contest or the awarding of prizes to be disrupted or impractical of being completed. Entry constitutes agreement to hold Contest Sponsor and their affiliated entities, together with its or their respective directors, officers, employees, agents, successors, and assigns, harmless from and against any and all physical injury, damages, liabilities, losses, and expenses arising out of this contest or acceptance or use of the prizes. The winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use of redemption of any prize. The Contest Sponsor reserves the right to suspend and/or cancel the contest should causes beyond their control interfere with the administration, security, or proper conduct of the contest. 

d) Let’s Talk Science / Parlons sciences respects your privacy and values our relationship with you. Your personal information will be protected and will never be sold. The information you have provided to enter this contest will be used only for contest administration and/or audit and in accordance with the terms of these Official Rules and Regulations and the Privacy Policy. If you have any questions or wish to obtain more information about our Privacy Policy, you may visit our web site at letstalkscience.ca. BY ENTERING THE CONTEST YOU CONSENT TO OUR USING, COLLECTING AND STORING THE PERSONAL INFORMATION THAT YOU PROVIDED IN ACCORDANCE WITH OUR PRIVACY POLICY AND THE OFFICIAL RULES AND REGULATIONS.

e) This Contest is offered only in Canada to Canadian residents. Ontario law will apply in the event of any disputes relating to or arising from the Contest and the Ontario courts shall have exclusive jurisdiction over all such disputes. The collection and use of personal information of the entrants and their parents and/or legal guardians by Let’s Talk Science / Parlons sciences will be subject to the Let’s Talk Science / Parlons sciences Privacy Policy. A copy of the Let’s Talk Science / Parlons sciences Privacy Policy can be obtained by writing to Let’s Talk Science / Parlons sciences at the address below or at letstalkscience.ca. Restrictions, conditions and limitations apply. 

BY ENTERING THIS CONTEST, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES AND REGULATIONS. These Official Rules and Regulations will be posted at all times during the Contest at https://letstalkscience.ca/thats-a-real-job-contest-rules. Entrants further agree to be bound by the decisions of the Contest Sponsor, which shall be final and binding in all respects. 

f) BY ENTERING THIS CONTEST AND PROVIDING YOUR CONTACT INFORMATION YOU CONSENT TO RECEIVING ELECTRONIC COMMUNICATION FROM US AT THE PROVIDED CONTACT INFORMATION. 

g) If any part of these Official Rules and Regulations is found to be unenforceable or illegal, then only that part that is illegal or unenforceable shall be severed from the rest of these Official Rules and Regulations to the extent of the illegality and unenforceability and the remainder of these Official Rules and Regulations shall remain enforceable to the fullest extent permitted by law.

8. LIMITATIONS OF LIABILITY. If, for any reason, the Contest can not be run as planned, the Contest Sponsor reserves the right at its sole and absolute discretion to cancel, terminate, modify or suspend the Contest. Except as expressly provided for herein, all prizes are provided to winners “as is” without warranty of any kind. IN NO EVENT SHALL CONTEST SPONSOR OR THOSE FOR WHOM CONTEST SPONSOR IS RESPONSIBLE AT LAW BE RESPONSIBLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES WHETHER OR NOT CONTEST SPONSOR OR THOSE FOR WHOM CONTEST SPONSOR IS RESPONSIBLE AT LAW HAS ACTUAL OR CONSTRUCTIVE KNOWLEDGE OF OR BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
